New York sues Polymarket for running an illegal gambling operation

New York Attorney General Letitia James and Governor Kathy Hochul on Thursday jointly sued QCX LLC, the United States operator of prediction marketplace platform Polymarket, accusing it of operating a gambling business in New York State without a gaming license. This is yet another regulatory pressure facing the forecasting market industry across states that could affect the expansion pace of Polymerate's operations at United States .

The core of the lawsuit: unlicensed operations and illegal profits

The lawsuit asks the court to stop Polymarket from operating in New York State. In addition to stopping operations, the state government has filed three demands: that the company surrender its profits determined to be illegally obtained, reimburse users for related payments and pay a fine of three times the amount of illegal income.

Controversy: Sports contracts are not gambling

Polymarket's United States platform, launched in December 2025, focuses on sports results markets where users can place bets to predict the outcome of competitions. The company said at the time that it planned to expand into other types of marketplaces in the future.

The State of New York contends that these contracts constitute gambling users' investments for events with uncertain outcomes under state law. Additionally, the suit points to an age compliance issue: Polymarket allows 18-20 year olds to use its platforms while New York states that participation in mobile sports betting must be at least 21 years old.

What it means for the industry

The prediction market has grown rapidly in recent years, but sports contracts have always been a central area of regulatory controversy. Prediction market firms often seek compliance routes at the federal level by positioning contract anchors for incidents, while whether state gambling regulations apply is the focus of repeated exchanges between regulators. If this lawsuit moves forward in New York State, it could provide a reference platform for other states to deal with similar issues.

As of this writing, a Polymarket spokesperson has not responded to requests for comment. Subsequent concerns are whether the court will accept an interim injunction request and if Polymarkt will make regional adjustments to its sports marketplace.
