United States Regulators warn of the risk of fraud in market trends on alert forecasting platforms

United States Commodity Futures Trading Commission (CFTC) issues guidance, commentary by influential people predicts market turmoil or difficulty in regulatory release

The Commodity Futures Trading Commission (CFTC) issued an employee guidance on Tuesday that specifically warns against prediction betting markets around certain individual actions. Such markets are popular with prediction market platforms such as Kalshi and Polymarket, and the new guidelines may mean it will be more difficult for these types of event contracts to pass regulatory scrutiny in the future.

Individual words and deeds are difficult to verify independently

The CFTC's market watchdog opinion notes that the characterization of a crypto-asset is fundamentally different from other prediction markets: in the latter, results are usually generated independently and can be externally verified without any single person controlling them, such as the publication of election results or economic data; whereas in the former, the win/loss criterion lies in specific behavior by a celebrity which may not have been produced independently nor necessarily verified externally.

In other words, it is possible for a party or someone close to them to use their knowledge of the betting situation and actively influence the outcome. For example, a public figure can purposely say something that has been wagered on, thereby influencing the market settlement.

High risk of manipulation identified by regulators

The guidance explicitly states that the CFTC's market watchdog, which is responsible for regulating this area, may consider such markets to be presumably highly susceptible to manipulation. Based on this judgment, the CFDTC hereby reminds operators of forecasting platforms that they are permitted to list only derivative contracts that cannot easily be manipulated.

This statement implies that contract products around celebrity speech and personal dynamics will face stricter compliance thresholds. For platforms such as Kalshi, Polymarket, the space for future compliance may be significantly narrowed in this once-growing category of investments.
